Terms & Conditions
1. The deposit and this signed agreement are required as a retainer.
2. All deposits and payments are non-refundable, in the event of a date change or shoot cancellation for any reason.
3. The remaining balance is due by close of shoot.

5. If Divine Eye Productions is unable to perform the guidelines of this contract due to a fire or other casualty, act of God, or other cause beyond the control of the parties, Divine Eye Productions shall have no further liability with respect to the agreement. If Divine Eye Productions is unable to perform to the obligations in this contract for any other reason, Divine Eye Productions will not be liable for costs in excess of the amount the Client has paid. This limitation of liability will also apply in the event that the high resolution digital files are lost through camera malfunction, damaged in processing, lost in the mail, or otherwise damaged or lost with or without fault of Divine Eye Productions. While every attempt is made to create the best images possible, no particular photo is guaranteed.
6. In the event of Photographer's illness or other unforeseen circumstance, Photographer may substitute another competent, professional photographer to take the photographs.
7. The Client may use the digital files for personal, non-advertising use with credit to www.divine-eye.com. (Additional licenses available. Please inquire.)
8. All rights to images created by Divine Eye Productions will remain with the Photographer. Divine Eye Productions reserves the right to display any photographs made in conjunction with the shoot as samples of Divine Eye Productions work for the purposes of exhibit, advertising promotion on the internet, publication, instruction, and professional competition.
9. Shoot time is consecutive and starts when Photographer arrives and finishes when Photographer leaves.
10. Any changes to this Agreement must be in writing and signed by both parties.
This Agreement incorporates the entire understanding of the parties and is governed by the laws of the State of California. By signing of this contract, the Photographer and the Client/s agree to all terms and conditions in this contract.
